02 /14.09.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State.

2. The petitioners are apprehending their arrest in connection with Giridih (Muffasil) P.S. Case No.54 of 2026, for the alleged offences registered under Sections 303(2), 317(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 30(ii) of Coal Mines Act pending in the Court of learned S.D.J.M., Giridih.

3. Learned counsel appearing for the petitioners submits that

the FIR has been registered against 10 named and 25 to 30 unknown persons. He further submits that allegations are there of trying to steal coal, however, theft was not done. He then submits that the petitioners have got no criminal antecedent as disclosed in

paragraph No.10 of the petition. On these grounds, he submits that anticipatory bail may kindly be granted.

4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of trying to steal coal from CCL storage house.

5. On perusal of the FIR, it transpires that allegations are there of throwing away three quintals of coal from storage of CCL and the allegations are there against 10 named persons and 25 to 30 unknown persons, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Giridih in connection with Giridih (Muffasil) P.S. Case No.54 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
