02/14.09.2026 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Nagar Untari P.S. Case No.47 of 2026, registered for the offence under Sections 318(4), 338 and 61(2) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Nagar Untari, Garhwa.

Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case and the allegations are made that petitioner no.1 being the son of the complainant, allegedly executed a sale deed in favour of petitioner no.2 by showing his father/complainant as dead in respect of 13 decimals of land comprised in old Khata No.227, Old Plot No.179 corresponding to new Khata No.583, Plot No.260. He submits that in the light of Annexure 2, which is enquiry report of the Circle Officer, Bhawnathpur contained in letter no.89 dated 11.03.2026, it is crystal clear that during pre-loading in computer, due to a

typing error in the registration office, father of the vendor was shown as deceased, whereas the father was alive and his name was correctly mentioned in the original sale deed. He also submits that petitioner no.1 has sold his own portion of land to the petitioner no.2 and the petitioners are having no criminal antecedent as disclosed in para 12 of the petition. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of concealing father identity in selling of the land.

Considering that the only allegation is made of selling the land concealing father identity, however, Annexure 2 prima facie suggests that that was later on corrected in the registration office at the time it was being uploaded in the computer and the petitioners are having no criminal antecedent as disclosed in para 12 of the petition and it has been pointed out that the petitioner no.1 has sold his own portion of land to the petitioner no.2, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the above-named petitioners are directed to surrender before the learned court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Nagar Untari, Garhwa, in connection with Nagar Untari P.S. Case No. 47 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
