The petitioner is apprehending his arrest in connection with Chandil P.S. Case No.164 of 2025, for offence registered under section 316/ 318, 126(2), 115(2), 352, 351(2) of BNS, 2023, pending in court of learned S.D.J.M., at Chandil.

Learned counsel for petitioner submits that allegations are made that the petitioner being proprietor of Kuber Traders took Rs.5 lacs for 18 hours due to business exigency. She next submits that both are in business terms and the petitioner herein has also lodged a case against the informant for not returning Rs.20 lacs. She further submits that the informant has issued a cheque in favour of the petitioner which was dishonoured and, in that case, the

petitioner herein has filed Complaint Case No.92 of 2026 under section 138 of Negotiable Instruments Act in which cognizance has been taken.

Learned State counsel opposes prayer and submits that the allegations are there of not returning the amount.

Prima-facie, it appears that both are in business terms and the informant has issued a cheque which has been dishonoured and for that the complaint case as aforesaid has been lodged by the petitioner, and in the attending facts and circumstances of the present case, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned S.D.J.M., at Chandil, in connection with Chandil P.S. Case No.164 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
