02 /18.06.2026 Heard the learned counsels appearing on behalf of the parties.

2. Learned counsel for the petitioner submits that the petitioner is in custody since 10.03.2026 in connection with Jirwabari P.S. Case No. 16 of 2026, registered under Sections 316(2), 318(2), 69 and 351(3) of Bharatiya Nyaya Sanhita, now pending in the court of learned Chief Judicial Magistrate, at Sahibganj.

3. Learned counsel for the petitioner further submits that the petitioner has been falsely implicated in this case. The victim is a widow having three children and she was working in the same office in which the petitioner was working.

As per the allegation itself, there was consensual relationship between them, but the victim has alleged that the relationship was established on the pretext of marriage and she was called by the petitioner to a temple and there the petitioner put vermillion on her head and photograph was also taken. However, subsequently the victim came to know that the petitioner had already married another woman. Further allegation is that the petitioner had taken Rs. 7 lakhs for treatment of his mother from the victim and 6 lakhs was returned to her, but 1 lakh was yet to be returned.

5. The learned counsel for the petitioner also submits that the victim is more than 40 years of age and the petitioner is 30 years of age.

6. Learned counsel for the informant, on the other hand, has opposed the prayer for bail and has submitted that the allegations are very serious and on the pretext of marriage, the petitioner has established physical

relationship. The learned counsel has also submitted that remaining Rs. 1 lakh has not yet been returned.

7. To this, learned counsel for the petitioner submits that the petitioner has returned Rs. 1 lakh in cash and there is a dispute as to whether Rs. 1 lakh has been ultimately returned to the victim or not.

After hearing the learned counsels for the parties and considering the fact that there appears to be some element of consensus with respect to the relationship between the parties who were working in the same office and the petitioner is in custody since 10.03.2026 and charge-sheet has already been submitted, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, at Sahibganj in connection with Jirwabari P.S. Case No. 16 of 2026, on the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be his close relative.

¶19

(iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned trial court.

9. The instant application is allowed with the aforesaid conditions. 10. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/e-mail.
