03 /19.03.2026 Heard the learned counsel appearing on behalf of the petitioner.

2. The learned counsel for the State is absent.

3. The informant of the case is present.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 28.02.2025 in connection with Gola P.S. Case No.25/2025 corresponding to G.R. No. 483/2025 (S.T. Case No.121/2025), registered under Section 115(2)/117(2)/118(1)/109(1)/ 3(5) of the B.N.S, 2023, now pending in the court of learned Sessions Judge, Ramgarh.

5. The learned counsel for the petitioner submits that the petitioner is in custody since 28.02.2025. He has further submitted that though there is direct allegation against the petitioner in the F.I.R, but the informant is not the eye witness to the occurrence. He has also submitted that the two co-accused i.e. the father and the mother of the petitioner have been enlarged on bail. The learned counsel has further submitted that the F.I.R. was registered primarily under Section 109 and subsequently upon death in the hospital, charge under Section 103 of BNS has been framed.

During the course of hearing, the case diary has been handed over to the learned counsel for the informant for perusal , he has not been able to point out any eye witness to the occurrence from the case diary. However, he has submitted that the petitioner is the main assailant and the victim had died due to head injury.

7. It is not disputed by the learned counsel for the informant that

the parties are agnates and that there is a land dispute between them. He has also not disputed that the informant himself is not an eye-witness to the occurrence.

Considering the fact that the co-accused has been granted bail and there is land dispute between the parties and the parties are agnates and the informant is not the eye witness to the occurrence, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Ramgarh in connection with Gola P.S. Case No.25/2025 corresponding to G.R. No. 483/2025 (S.T. Case No.121/2025), on the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be his close relative.

¶25

(iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned trial court.

9. The instant application is allowed with the aforesaid conditions.
