1. Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Lohsinghna P.S. Case No.208 of 2024 for the alleged offences registered under Sections 61(2), 238, 318(4), 319, 336(3), 340(2) & 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Additional Chief Judicial Magistrate, Hazaribagh.
3. Learned counsel appearing for the petitioners submits that the allegations are made of illegally paying 23 home guards in the District of Hazaribagh. He next submits that the petitioner was a District Commandant and posted in the District of Hazaribagh from 26.02.2021 to 23.08.2024. He submits that the said home guards were already working there since 2019. The petitioner had not engaged them as the petitioner has joined the said place later on. He also submits that the District Commandant who was posted there earlier has already been granted anticipatory by the co-ordinate Bench of this Court in A.B.A. No.1763 of 2025. He also submits that the petitioner is cooperating in the investigation. On these grounds, he submits that anticipatory bail may kindly be granted.
4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of illegally paying 23 home guards that too in crores. She next submits that in the case diary there are materials against the

petitioner. In view of the above, the prayer for anticipatory bail may kindly be rejected.

From perusal of the FIR, it transpires that the person who had engaged the said home guards was there since the year 2019 while the petitioner had joined the said place from 26.02.2021 to 23.08.2024. It has been pointed out the petitioner is cooperating in the investigation and the District Commandant who was posted there prior to posting of the petitioner has already been granted anticipatory bail by the co-ordinate Bench of this Court in A.B.A. No.1763 of 2025. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioner.
6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Hazaribagh in connection with Lohsinghna P.S. Case No.208 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
