02/11.09.2026 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Bardiha P.S. Case No. 11 of 2026, registered for the offence under Sections 130(1), 238 and 61(2) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1^st Class, Garhwa.

Learned counsel appearing for the petitioners submits that the petitioner no.1 is the wife of the deceased and petitioner nos.2 and 3 are father-in-law and mother-in-law respectively of the deceased. She submits that the deceased was in habit to take liquor and was also addicted to play gambling and due to this reason, petitioner no.1 had left her husband and was residing at her parents house for many days due to this there was rift between both families. She also submits that the dead body of the deceased was recovered from the village Jatro Banjari which is situated far away from the residence of the petitioners and near to the residence of the informant. She also submits that there are no eye witness. She next submits that there was good relationship between husband and wife and the petitioners are having no criminal antecedent. She further submits that this is a case of circumstantial evidence and in view of that anticipatory bail may kindly be granted to the petitioners.

Learned counsel appearing for the State opposes the prayer and submits that the petitioners are wife, father-in-law and mother-in-law

respectively of the deceased. On these grounds, he submits that prayer for anticipatory bail of the petitioners may kindly rejected.

Considering that the dead body of the deceased was recovered from the village Jatro Banjari which is situated far away from the house of the petitioners and nearby the residence of the informant, prima facie this is a case of circumstantial evidence, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the above-named petitioners are directed to surrender before the learned court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Garhwa, in connection with Bardiha P.S. Case No. 11 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
