2. The petitioner is apprehending his arrest in connection with Mahila P.S. Case No.30 of 2025 for the alleged offences registered under Sections 64, 318(4), 115(2), 351(3) and 3(5) of Bharatiya Nyaya Sanhita pending in the Court of learned JMFC, Ranchi.

3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the allegation of cheating is not correct. He further submits that only with intention to blackmail the petitioner the case has been instituted. He then submits that save and except the suspicion there is nothing against the petitioner. On these grounds, he submits that anticipatory bail may kindly be granted.

4. Learned counsel appearing for the State opposes the prayer and submits that serious allegation is made against the petitioner of cheating. He further submits that allegations are thereafter made of intoxicating the informant and committing rape. On these grounds, he submits that anticipatory bail may kindly be rejected.

On perusal of the FIR it transpires that the petitioner is neighbour of the informant and he started coming to the house of the informant, who was residing along with her family and gained her sympathy. He used to take money from the informant and subsequently he has shown a plot and taken amount of Rs.25 lacs and the total concession amount was fixed at Rs.25 lacs and she has transferred Rs.9,48,000/- in his account and Rs.7,00,000/- was handed over to him in cash and when the land is not provided the petitioner has also issued three cheques which has been dishonored on 31.10.2024. It is further alleged that on 21.10.2024 when the husband of the informant has gone to home village this petitioner has came there in the house and offered cake and sweets on the pretext of his birthday. The allegations are made that in the said cake and sweets intoxication was mixed up and when she was unconscious, she was raped by the petitioner. In paragraph No.2 of the case diary, the informant has supported the case and further in paragraph No.12 and 13 statement of other witnesses have been recorded and they have also supported the allegation and in paragraph No.14 husband of the informant has also supported the

6. In the attending facts and circumstances of this case, I am not inclined to grant privilege of anticipatory bail to the petitioner, hence, the prayer for anticipatory bail of the petitioner is hereby rejected.

7. Interim order, granted earlier, is hereby vacated.
