02/ 11.09.2026 : Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Kunda P.S. Case No. 41 of 2026 registered under sections 103(1), 3(5) of B.N.S, 2023, pending in the Court of learned C.J.M, Deoghar.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. He next submits that allegation of murder of the son of the informant is not correct. He next submits fact remains that the son of the informant met with an accident in course of driving motorcycle and due to that accident he has died. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations of murder are there and in the post mortem report it has come that death has occurred due to asphyxia.

It transpires that entire family members have been made accused. In para 11 of the case diary the re-statement of the informant is there in which informant has stated that there was a dispute between the

father-in-law of the deceased with the deceased regarding motorcycle one year ago. He has stated that he has received one phone call that his son met with an accident and was admitted in Sadar Hospital, Deoghar. Another witness also stated that the motorcycle of the deceased met with an accident and he was taken to Sadar Hospital where he has died. In the next pages also the witnesses stated same thing about the deceased.

In the attending facts and circumstances of the case, I am inclined

to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/(twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned C.J.M, Deoghar, in connection with Kunda P.S. Case No. 41 of 2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
