Heard the parties.

The petitioner has been made accused in connection with Katkamsandi P.S Case No. 242 of 2025 registered for the offences punishable under Sections 317(5), 3(5) of the B.N.S., 2023, sections 21 (c), 22 of the N.D.P.S Act and sections 27 (b) (ii) of Drugs and Cosmetic Act

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner along with the co-accused persons was in joint possession of 10 bottles of Onerex cough syrup of 100 ml each. It is next submitted by the learned counsel for the petitioner that even assuming for the sake of argument that the seized cough syrup was of 1 litre but the weight corresponding to such volume is 910 grams. It is next submitted that hence the narcotic drugs seized is of intermediate quantity. It is submitted that the allegation against the petitioner is false. It is further submitted that the petitioner has been in custody since 27.11.2025 as has been mentioned in para-10 of the bail application. It is then submitted that the petitioner has got no criminal antecedent as has been mentioned in para 11 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence it is submitted that the petitioner be released on bail.

Learned Spl. P.P. opposes the prayer for bail.

Considering the aforesaid facts of this case and the co-accused person has been granted bail by this Court in B.A. No. 2945 of 2026 on 17.04.2026, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand)

with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, N.D.P.S Act at Hazaribagh in connection with Katkamsandi P.S Case No. 242 of 2025 with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
