Heard the parties.

The petitioner has been made accused in connection Simdega P.S. Case No.40 of 2026 registered for the offences punishable under Section 317(5) of the B.N.S., 2023 and Section 21(b) of N.D.P.S. Act.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was in illegal possession of 40 pieces of Pyeevon Spas Plus and 60 pieces of Nitrazepam capsules. The report of the drug inspector shows that in the seized capsules contains some Tramadol Hydrochloride. It is next submitted that the seized tablet comes under small quantity. It is further submitted that the petitioner has got no criminal antecedents as mentioned in para-09 of the instant bail application. It is further submitted that no one has sustained any injury. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the witnesses of the case. It is lastly submitted that the petitioner has been in custody since 09.03.2026 as mentioned in para-01 of instant bail application. Hence it is submitted that the petitioner be released on bail.

Learned Addl. P.P. appearing for the State opposes the prayer for bail.

Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/-

(Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, (NDPS) Simdega in connection with Simdega P.S. Case No.40 of 2026 with the condition that they will co-operate with the trial of the case and furnish their mobile number and photocopy of the Aadhar Card in the court below with an undertaking that they will not change their mobile number during the trial of the case in any manner, during trial of the case .
