This Bail Application under Section 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been filed to release the petitioner on regular bail in connection with Jamtara Cyber Crime P.S. Case No.66 of 2025, for offences under Sections 111(2)(b), 317(2), 317(5), 318(4), 319(2), 336(3), 338 and 340(2) of the Bharatiya Nyaya Sanhita (BNS) 2023, Sections 66 (B), (C) and (D) of the Information Technology Act and Section 42(3) (e) of the Telecommunications Act, 2023. The case is presently pending before the Court of learned Special Judge, Cyber Crime, Jamtara.

2. Heard learned counsel representing the petitioner and learned Spl. P.P. representing the State. Perused the material available on record and also gone through the impugned order. 3. Earlier, the bail application of this petitioner was dismissed by this Court vide order dated 02.04.2026 in B.A. No.682 of 2026. This is the second attempt. 4. There is allegation against this petitioner that on 06.11.2025 he was caught by the police doing cyber fraud while conducting raid on secret information that cyber-crime is being committed. On conducting search, three smart phones of different companies and two iPhone and different active SIM cards were recovered from the petitioner’s possession.

5. Learned counsel representing the petitioner submits that the petitioner is innocent and has been falsely implicated in the case. He further submits that the recoveries made from this petitioner were planted by the police and case has been filed on mere suspicion. He submits that the petitioner is in custody since 06.11.2025.

6. Learned Spl. P.P. representing the opposite party – State, opposes the prayer for bail.

After hearing the parties and going through the record, especially the impugned order, I find that the petitioner has been named in the F.I.R. and the criminal link has also been established in the investigation. The petitioner has also confessed before the police that he used to deceive people and defraud money from them by cheating. The CDR report establishes the criminal link between this petitioner and fraud done by him, as eleven online complaints are registered in the Indian Cybercrime Coordination Centre (I4C) Portal against one of the SIM cards recovered from him bearing number 8279598763. On investigation, the statement of Geeta Devi, on whose name the alleged SIM Card is allotted has also come on record revealing that the SIM was not purchased by her and it is fake and is not being used by her and it is obtained using her fake ID card.

8. Considering the aforesaid fact, I am not inclined to grant bail to the petitioner.

9. Accordingly, the Bail Application is dismissed .
