02/09.07.2026 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Borio P.S. Case No. 12 of 2026, registered for the offence under Sections 191(2), 191(3), 190, 126(2), 127(2), 115(2), 117(2), 109(1), 132, 121(2), 223B, 308(2), 308(5), 351 and 352 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, Sahibganj.

Learned counsel appearing for the petitioners submits that in a road accident, four years girl has died and pursuant to that 19 named accused persons and 100 unknown persons were agitating and blocked the road and for that FIR has been lodged. She next submits that the petitioners are the innocent villagers and only allegations are made of agitating pursuant to the said accident and they are having no criminal antecedent as disclosed in para 17 of the petition. She also submits that other co-accused persons have been granted bail by this court in A.B.A. Nos.3194 and 2765 of 2026.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of blocking the road.

Considering that the allegations are there against 19 named accused persons and 100 unknown blocking the road and agitation was going on due to death of a four years child in a road accident and that allegations are general and omnibus against all the accused persons including the petitioners and further they are having no criminal antecedent

as disclosed in para 17 of the petition and other co-accused persons have been granted bail by this court in the aforesaid A.B.As., in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Sahibganj, in connection with Borio P.S. Case No.12 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
