At the outset, learned counsel appearing for the petitioners submits that petitioner no.1 has already been apprehended and in view of that he is withdrawing the anticipatory bail application of petitioner no.1Anil Ganjhu @ Anil Gajhu.

In view of the submission, prayer for anticipatory bail of petitioner no.1- Anil Ganjhu @ Anil Gajhu is hereby, dismissed as withdrawn.

The petitioner nos.2 and 3 are apprehending their arrest in connection with Bariyatu P.S. Case No. 08 of 2026, registered for the offence under Sections 15(c), 18(b), 22, 25 and 29 of the N.D.P.S. Act, pending in the court of learned Special Judge, N.D.P.S., Latehar.

Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case alleging that the petitioners were involved in cultivation of poppy plants on the forest land and Gairmazurua land. He further submits that the petitioners are the villagers and having no criminal antecedent as disclosed in para 12 of the petition and one of the co-accused has been granted anticipatory bail in A.B.A. No.3371 of 2026.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against the petitioners of cultivation of poppy plant on the forest land and Gairmazurua land.

Considering that the land is of the Forest Department and the nature of land is Gairmazurua and further the land is not belonging to the petitioners and the petitioners are having no criminal antecedent as disclosed in para 12 of the petition and one of the co-accused has been granted anticipatory bail in the aforesaid A.B.A., in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner nos.2 and 3.

Accordingly, the petitioner nos.2 and 3 are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S., Latehar, in connection with Bariyatu P.S. Case No. 08 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
