The petitioners are apprehending their arrest in connection with Keredari P.S. Case No.43 of 2026, registered for the offence under Sections 190, 191, 126(2), 115, 117, 308(3), 351(2) and 352 of the BNS, pending in the Court of the learned Judicial Magistrate, 1^st Class, Hazaribagh.

Learned counsel appearing for the petitioners submits that the petitioners are local residents of village- Dumri. He further submits that false allegations are made of assaulting the guard and labourer of the L&T construction company. He also submits that the petitioners are having no criminal antecedents, as disclosed in paragraph 15 of this application. He next submits that the altercation took place because the staff of L&T company have tried to dispossess the local residents.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of altercation with the staff of L&T company and in view of that, the prayer for anticipatory bail may kindly be rejected.

Considering that the petitioners are local villagers and altercation took place when the staff of L&T company have tried to dispossess the local residents and further, the petitioners are having no criminal antecedents, as disclosed in paragraph 15 of this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Hazaribagh in connection with Keredari P.S. Case No.43 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
