1. Heard learned counsel for the applicant and learned counsel for the State.
2. The applicant, who is in custody since 16.07.2025, has renewed his prayer for grant of regular bail in connection with Giridih Town P.S. Case No.172 of 2025, registered for the offence under Section 308(2), 308(5), 303(2), 351(2), 317(2) & 3(5) of the BNS, 2023, pending in the court of learned Chief Judicial Magistrate, Giridih.
3. The prayer for bail of the applicant was earlier rejected by this Court, vide order dated 16.02.2026 passed in B.A. No.10108 of 2025. 4. It has been submitted by the learned counsel for the applicant(s) that complete set of FIR along with its enclosure have been annexed with this bail application and there is no suppression on his/her part.
5. Innocence has been claimed by the learned counsel for the applicant and undertaking has been given for participation in the trial. It has been submitted that this applicant has remained in custody for more than a year. Further, one of the co-accused person namely, Afroj Sheikh @ Afroj @ Md. Afroj, has already been granted bail by the Co-ordinate Bench of this Court, vide order dated 25.09.2025 passed in B.A. No.8668 of 2025. On the above basis, prayer for bail has been made.
6. Learned counsel for the State has opposed the prayer for bail submitting that the applicant is a habitual offender having two criminal antecedents.

7. From perusal of the bail order passed by the Co-ordate Bench of this Court, it appears that the bail was granted to that co-accused only on the ground that he had no criminal antecedent.
8. Considering the above facts the materials available on record, I am not inclined to reconsider the prayer for grant of bail to the applicant once again. Accordingly, his prayer for grant of bail is hereby, rejected .
