1. Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 376(3) of IPC and Section 4&6 of POCSO Act, whereas charge has been framed under sections 376(3), 376(2)(n) of IPC and under Section 6 of the POCSO Act, in connection with Mufassil (Pandrasali O.P.), P.S. Case No. 170 of 2023 (Now, Spl. POCSO Case No. 49/2023), pending in the Court of Additional Sessions Judge-II-cum Spl. Judge, POCSO Act Cases, West Singhbhum, at Chaibasa.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the details of the victim and her relatives has not been disclosed in the entire petition. He further submits that the petitioner has been implicated due to personal grudge and enmity. He further submits that petitioner is languishing in jail custody since 09.10.2023; as such, he may be released on bail.

4. Learned A.P.P opposes the prayer for bail of the petitioner and submits that there are specific allegations against the petitioner.

5. Having regard to the gravity of the offence and the allegations against the petitioner, coupled with the fact that the trial is going on and the victim has supported the prosecution case, I am not inclined to enlarge this petitioner on bail.

6. Accordingly, the instant application stands dismissed.
