The petitioner is apprehending his arrest in connection with Basiya P.S. Case No.01/2026, registered for the offence under Sections 316(2), 318(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of the learned Additional Chief Judicial Magistrate, Gumla.

Learned counsel appearing for the petitioner submits that so far as this petitioner is concerned, only allegation is made against him that he has helped in transfer of the compensation amount arising out of Motor Vehicles Act to the father and mother of the deceased. He further submits that the informant alleged to be wife of the deceased and she has stated that money has been paid to the father and mother of the deceased. He submits that co-accused has been granted anticipatory bail in A.B.A. No.785 of 2026.

Learned counsel appearing for the State opposed the prayer and submits that this petitioner has helped in getting the money of the compensation amount to the father and mother of the deceased.

Considering that only allegation is made against the petitioner that

case and in payment of the compensation amount and apart from that there is no allegation against the petitioner of taking any money of the said compensation amount and the compensation amount has been paid to the father and mother of the deceased and co-accused has been granted anticipatory bail in the aforesaid A.B.A and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gumla in connection with Basiya P.S. Case No.01/2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
