02/ 30.03.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 126(2)/115(2)/119(1)/308(2)/318(2)/ 324(5)/ 61(2)/ 3(5) of BNS.

Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.

Learned Spl. P.P. opposes the prayer for bail.

Prosecution story is that the informant is the Secretary of Saint Kabir Society in Jharkhand and is in possession of certain land. When the informant was cleaning the land and repairing the boundary wall, the accused persons came there and threatened the informant and the labourers. They took the names of Prince Khan and Gop Khan and demanded Rs.2 crores as extortion money. They also came few more times and assaulted and threatened the informant party.

After going through the records, I find that there is admittedly land dispute amongst the parties. Further, it is alleged that the complaint, which gives rise to FIR was filed at a belated stage. As per the complaint itself, the first occurrence took place on 11.12.2024, thereafter again on 06.01.2025, 10.05.2025 and 10.08.2025 occurrence

took place, but the case was filed only on 08.01.2026.

Considering the fact that there is serious land dispute amongst the parties which gave rise to this litigation and there is delay in filing complaint, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned JMFC at Dhanbad, in connection with Barwadda P.S. Case No.11 of 2026, subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand with a further condition that the petitioner shall appear and mark his attendance before the Registrar, Civil Court, Dhanbad once in a month till the disposal of the trial.
