Yuvraj Kumar Singh Vs the State of Jharkhand

The instant application has been filed under Sections 483 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of bail in connection with Nirsa P.S. Case No.01 of 2026 registered under Sections 115(2), 126(2), 352, 109, 3(5) of BNS, pending in the court of learned Judicial Magistrate, 1^st Class, Dhanbad.

Learned counsel for the petitioner has submitted that he has been implicated in this case and the entire case has been planted by the informant.

The allegation against the petitioner is that on 01.01.2026 at about 01:30 PM when informant Niranjan Kumar Chouhan was going from Kali Mati Colony to Birsingpur to collect his dues money, on the way, he met Rahul Singh and his friend Kanhaiya Yadav, informant demanded his money from Rahul Singh then both of

them abused and assaulted informant. It is further alleged that they also called Suraj Singh, Yuvraj Singh and Prasanjit Bagti with an intention to commit murder of the informant they targeted him and open fire upon him.

Nothing incriminating material has been recovered from the possession from the petitioner. He is in custody since 04.01.2026.

Learned Additional Public Prosecutor appearing for the opposite party-State although has seriously opposed the prayer for grant of bail and submitted that petitioner is named accused, he fired bullet upon informant in order to take his life. Six round of empty bullet was recovered from place of occurrence. On the disclosure of the petitioner, country made pistol was recovered.

Heard learned counsel for the parties and on perusal of the FIR, it transpires there is direct allegation against the petitioner that he [Yuvraj Singh] and Suraj Singh were firing upon the informant. Further, from the impugned order, it appears that the learned court has found from the case dairy that prosecution witnesses have supported prosecution case in para 21,24,25,26 of the case diary. At paragraph 5 of the Case diary, the Investigating Officer has stated that he collected six empty cartridge near place of occurrence after preparing

seizure list. IO arrested the petitioner, Yuvraj Singh from his house who was trying to flee towards Dhanbad mentioned as mentioned in para 46 of the case diary. Yuvraj Singh confessed his guilt mentioned in para 49 and on his disclosure pistol used during crime was recovered in presence of witnesses from Forest and bush inside Deviyana Gate. Besides that there is criminal antecedent of the petitioner also as mentioned in para 9 of the case diary, which shows that three cases are pending related to extortion, smuggling of coal and Arms Act against petitioner.

This Court, considering the nature of offence and there is direct and specific allegation against petitioner that he attempted to kill informant by firing bullet; and further the weapon used in the crime is recovered on his disclosure, is of the view that the present application is not fit to be allowed.

Accordingly, the instant application stands rejected at this stage.
