The petitioner is apprehending his arrest in connection

with Complaint Case No.165 of 2024, for offence registered under section 33 (1)(c ) of Indian Forest Act, pending in court of learned Chief Judicial Magistrate, Chatra.

Learned counsel for petitioner submits that only on suspicion the name of the petitioner has been inserted in the FIR and the allegations are there that the petitioner was cultivating poppy plant in the forest land and even the land is not belonging to the petitioner and the portioner is having no criminal antecedent as disclosed in paragraph no.11 of the petition.

Learned State counsel opposes prayer and submits that the allegations are there of cultivating poppy plant in the forest land.

Considering that the name of the petitioner has come only on suspicion and even the land is not belonging to the

petitioner and it belongs to the forest department and the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Complaint Case No.165 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
