2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 341, 323, 379, 376, 511 and 34 of I.P.C. and Sections 8 and 12 of the POCSO Act, 2012.

3. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. Learned counsel for the petitioner submits that petitioner has neither tried to commit rape upon the victim nor committed any overt act what has been alleged in the FIR. He further submits that alleged occurrence took place on 24.03.2022 but the present FIR was lodged on 31.03.2022 which itself casts suspicion upon the prosecution version. Petitioner has no criminal antecedent. He further submits that petitioner is languishing in custody since 17.12.2025; as such, the petitioner may be enlarged on bail. Learned counsel further submits that the petitioner is ready to abide by every condition imposed by this court.

4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

5. Having regard to the facts of the case and also para-44 of the case diary, which has been produced by learned counsel for the petitioner; I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond

of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Giridih, in connection with Birni P.S. Case No. 65 of 2022.

6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and if any adverse report will come against the petitioner, learned trial court shall be at liberty to cancel the bail of the petitioner.
