The instant C. M. P. No. 204 of 2026 has been filed under Article 226 of the Constitution of India on behalf of the petitioner for restoration of W. P. (C) No. 5795 of 2025, which stood dismissed on 14.11.2025 for non-compliance of the order dated 07.11.2025 passed by this Court in W. P. (C) No. 5795 of 2025.

It has been submitted by the learned counsel for the petitioner that due to illness of the Advocate Clerk, who was suffering from fever, the requisites could not be filed within time and as such, W. P. (C) No. 5795 of 2025 stood dismissed due to non-compliance of the order dated 07.11.2025 passed by this Court. However, learned counsel for the petitioner undertakes to file requisites within one week, if the W. P. (C) No. 5795 of 2025 is directed to be restored. It is further

submitted that the petitioner will remain careful in future and hence, C. M. P. No. 204 of 2026 may be allowed and W. P. (C) No. 5795 of 2025 may be restored to its original file.

On the other hand, learned counsel for the State raised no objection.

Having heard learned counsel for the parties and in view of the averments made in para-6, 7 and 8 of the C.M.P. No. 204 of 2026, the present C.M.P. No. 204 of 2026 is allowed and W. P. (C) No. 5795 of 2025 is restored to its original file.

However, learned counsel for the petitioner is directed to file requisites in W. P. (C) No. 5795 of 2025 within one week from today.
