The petitioner is an accused in the case registered for the offences punishable under Sections 338, 336(3), 340(2), 271, 272, 274, 275, 318(4) and 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 47(A) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. The petitioner was allegedly apprehended from a place where country made liquor was illegally being manufactured and from the said place 200 litres of foreign liquor and 132 litres of country made liquor were also seized. It is further submitted that the similarly situated co-accused Bashir Alam has already been granted regular bail by a Bench of this Court vide order dated 17^th February, 2026 passed in B.A. No.10889 of 2025. The petitioner is in judicial custody in connection with the

present case since 17^th September, 2025. Hence, he may be given the privilege of regular bail.

Learned A.P.P. opposes the petitioner’s prayer for regular bail.
