The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No. 07 of 2020, registered for the offence under Sections 414/34 of the Indian Penal Code and Section 30(ii) oif Coal Mines Act, pending in the court of learned Judicial Magistrate, 1st Class, Dhanbad.

Learned counsel appearing for the petitioner submits that although the FIR is of the year 2020, however, recently the petitioner has received the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023. She next submits that the vehicle has already been released in favour of the petitioner in the year 2020 itself and allegations are made that the said vehicle was parked near the brick kiln. She further submits that several other co-accused persons have already been provided the privilege of anticipatory bail in A.B.A. Nos. 7081 and 7093 of 2020 and in A.B.A. No. 4752 and 5374 of 2021 by the co-ordinate bench. She further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in

Learned A.P.P. appearing for the State has opposed the prayer and submits that the vehicle was found parked near the brick kiln.

Considering that in the identical situation, several coaccused persons have already been provided the privilege of anticipatory bail in the aforementioned A.B.As. and further the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-17 of the petition and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
