The petitioner is apprehending his arrest in connection with Katkamdag P.S. Case No. 33 of 2025, registered under sections 112(2), 316(2), 318(2), 336 (3), 338, 340(2), 3 (5) of BNS, 2023, pending in the Court of learned Judicial Magistrate Ist Class, Hazaribagh.

Learned counsel for the petitioner submits that police has raided the house of one Kshitij Kumar and on his confessional statement the name of one Eklavya Kumar has transpired and thereafter in the confessional statement of both Kshitij Kumar and Ekalavya Kumar the name of the petitioner has come. He submits that in identical situation two of the co-accused persons have been granted anticipatory bail by the Co-ordinate Bench of this Court in A.B.A. No. 2539 of 2025 vide order dated 08.07.2025, A.B.A. No. 3886 of 2025 vide order dated 29.07.2025 and one of the co-accused has been granted anticipatory bail by this Court in A.B.A. No.4038/2025 vide order dated 04.08.2025. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that in the confessional statement of the co-accused the name of the petitioner has come.

Considering that the name of the petitioner has come in the confessional statement of the co-accused and two of the co-accused persons have already granted anticipatory bail by the Co-ordinate Bench of this Court in A.B.A. No. 2539 of 2025 vide order dated 08.07.2025 and A.B.A. No. 3886 of 2025 vide order dated 29.07.2025 and one of the co-accused has been granted anticipatory bail by this Court in A.B.A. No. 4038/2025 vide order dated 04.08.2025 I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner above named, is directed to surrender before the learned court within three weeks from

today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate Ist Class, Hazaribagh, in connection with Katkamdag P.S. Case No. 33 of 2025 subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
