1. Learned counsel for the petitioner submits that the petitioner is in custody in connection with Naudiha Bazar P.S. Case No. 22 of 2024 corresponding to G.R. No. 1403 of 2024 (S.T. Case No. 06 of 2025) for the offence registered under Section 302 of the Indian Penal Code and Sections 25(1-B)A, 26 and 27 of the Arms Act, now said to have been pending in the court of learned Additional Sessions Judge-IX, Palamu at Daltonganj.

2. The bail application of the petitioner was rejected vide order dated 18.12.2024 in B.A. No. 10705 of 2024.

3. Learned counsel for the petitioner submits that he has renewed the prayer for bail by annexing the evidence of two witnesses during trial. He submits that none of them are the eye-witness to the occurrence. He has also submitted that there are total six witnesses.

4. Learned counsel for the opposite party-State has opposed the prayer and has submitted that there is direct allegation against the petitioner. He submits that the witnesses will be promptly produced by the prosecution, so that the trial is taken to a logical end.

5. After hearing the learned counsel for the parties and considering the fact that there is direct allegation against the petitioner, who is alleged to have shot his father over property dispute who succumbed to his injuries, this Court is not inclined to enlarge the petitioner on bail.

6. However, the State is directed to ensure prompt production of the witnesses during trial.

7. Learned counsel for the State is directed to communicate a copy of this order to the Superintendent of Police of the concerned district to ensure prompt production of the witnesses on the date as may be fixed by the learned trial court.

8. Let a copy of this order be communicated to the court concerned through ‘e-mail/FAX’.
