The petitioner is apprehending his arrest in connection with Complaint Case No.4942 of 2025, registered for the offence under Sections 47(a), 47(b), 47(c), 47(d), 47(e), 52(d) and 55 of the Excise Act, pending in the Court of the learned Judicial Magistrate, 1^st Class, East Singhbhum, Jamshedpur.

Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the confessional statement of the co-accused, who has been apprehended from the spot. He further submits that the allegations are made of recovery of 754.20 liters of foreign liquor and 100 liters of spirit from one of the house and that house is not of the petitioner.

Learned counsel appearing for the State opposed the prayer and submits that the name of the petitioner has come on the confessional statement.

Considering that the name of the petitioner has come on the confessional statement and the recovery is not made from the place of the petitioner as has been pointed out by the learned counsel appearing for the petitioner and in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions as the learned Court may deem fit and proper.

Accordingly, this application is disposed of.
