1. Heard learned counsel for the parties.

2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 118(2)/109/351(3)/3(5) of the Bharatiya Nyaya Sanhita (BNS) and Section 27 of the Arms Act in connection with Sahibganj (M) P.S. Case No. 26/2025.

3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has committed no offence as alleged in the F.I.R. He further submits that the petitioner is not named in the F.I.R. and the informant has disclosed the name of all accused persons in the F.I.R. who had fired upon except the name of the petitioner. He further submits that the petitioner for no offence has been languishing in custody since 30.08.2025; as such, the petitioner may be enlarged on bail. He submits that the petitioner is ready to abide by every condition as imposed by this court.

4. Learned A.P.P. opposes the prayer for bail of the petitioner.

Having regard to the facts of the case and looking to the allegations made against this petitioner coupled with the fact that the petitioner is not named in the FIR and that the petitioner is in custody since 30.08.2025; therefore, I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sahibganj in connection with Sahibganj (M) P.S. Case No. 26/2025.

It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall cooperate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
