2. Heard Mr. V.S. Sahay, learned counsel appearing on behalf of the opposite party- State of Jharkhand.

3. Learned counsel for the petitioner submits that the petitioner is in custody since 05.09.2025 in connection with Adityapur P.S. Case No. 275 of 2025, registered under Sections 126(2)/127(2)/115(2)/117(2)/109(2)/324(4)/125(a)/125(b)/352/351(2)/ 3(5) of B.N.S., 2023, now pending in the court of learned Chief Judicial Magistrate, Seraikella.

4. Learned counsel for the petitioner submits that though the petitioner has been named in the First Information Report, but in the CCTV footage, the petitioner is nowhere in picture. She has referred to paragraph 61 of the case-diary and has submitted that vivid description of the incident has been mentioned on the basis of CCTV footage but the petitioner has not been found in the footage.

5. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that the petitioner has been named in the First Information Report at sl. No. (5) of paragraph 12 itself.

6. To this, learned counsel for the petitioner has submitted that the petitioner is in custody since 05.09.2025 and the charge-sheet has already been submitted.

considering the aforesaid submissions and also the paragraph 61 of the case-diary with regard to CCTV footage and the custody of the petitioner since 05.09.2025, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/-(Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Seraikella in connection with Adityapur P.S. Case No. 275 of 2025, on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned trial court.

8. The instant application is allowed with the aforesaid conditions.
