Case No. 73/2023 (ss. 419, 420, 406, 467, 468, 471 IPC), pending before the S.D.J.M., Dumka. Counsel submitted that the matter was essentially a friendly/personal loan of Rs.1,10,000/- from the informant, of which Rs.50,000/- had already been returned (on 18.11.2023, account No.38178142431), and that under an agreement (Annexure-2) the petitioner was to return the balance Rs.60,000/- within one month, whereafter the FIR would be withdrawn; the petitioner remained ready to pay the Rs.60,000/-. The co-accused, Jeet Kumar Dey, who had taken Rs.40,000/-, had already been granted regular bail on the basis of the compromise. The petitioner is apprehending his arrest in connection with Masalia P.S. Case No. 73/2023 registered for offence under sections 419, 420, 406, 467, 468, 471 of I.P.C., pending in the court of learned S.D.J.M., Dumka.

Learned counsel appearing for the petitioner submits that the petitioner, informant and Jeet Kumar Dey are good friends and the informant has given money as a personal loan to the petitioner to the tune of Rs.1,10,000/-. He also submits that the petitioner has already returned Rs.50,000/- to the informant on 18.11.2023 in account No.38178142431. He also refers to Annexure-2, which is the agreement made between the petitioner and informant and submits that they have reached to an agreement that the petitioner will return Rs.60,000/- to the informant within one month and thereafter it is agreed that the FIR will be withdrawn. He also submits that the petitioner is still ready to give Rs.60,000/-. He next submits that Jeet Kumar Day has taken a sum of Rs.40,000/- and on the basis of the

Considering that the petitioner has already returned a sum of Rs.50,000/- to the informant and it has been pointed out that as a friendly loan, the amount of Rs.1,10,000/- was taken by the petitioner from the informant, the agreement is there between the petitioner and the informant, in which the petitioner further agreed to return Rs.60,000/- and in course of the argument, it has been pointed out that the petitioner is ready to return the same, in that view of the matter, the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition and sureties, as the learned Court may deem fit and proper.
