06/10.03.2026 Heard Mr. Rajesh Kumar, learned counsel for the petitioner and Mrs. Lily Sahay, learned APP for the State.

The present bail application has been filed on behalf of the petitioner namely, Satyendra Yadav for grant of regular bail who is in custody in connection with Netarhat P.S. Case No. 12 of 2024 instituted for the offences under Sections 190, 191, 126, 115, 117(4), 324(3), 326(f), 352 of the B.N.S and Section 17 of C.L.A. Act.

As per FIR, 12-13 unknown miscreants claiming themselves to be the member of Bha-K-Pa Maoist Party arrived at BSNL Tower situated near Netarhat and damaged the entire solar plates, 08 (Eight) batteries, A.C.D.V and CCU and they also put on fire the battery, CCU and entire cable and they also assaulted the BSNL employees including the Informant.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. It is submitted that the petitioner is not named in the FIR and his name has come on the basis of spy for the first time as disclosed at Para- 133 of the case diary. It is submitted that five (05) persons

are named in the FIR who are said to be the terrorist, however, the petitioner is not named. It is submitted that Para-133 of the case diary shows that five persons, namely, Satyendra Yadav (Petitioner herein), Rajendra Yadav, Surajnath Yadav, Ram Prasad Yadav @ Prasad Yadav and Krishna Yadav were also involved in this case and later on, the confession of all the said five (05) persons were recorded including the petitioner at Paragraph-138 of the case diary. It is submitted that other three (03) persons namely, Rajendra Yadav, Surajnath Yadav and Krishna Yadav, who were apprehended with this petitioner and another co-accused namely, Prasad Yadav @ Ram Prasad Yadav, who was also apprehended with this petitioner, had been granted bail by the Co-ordinate Bench (Justice Ambuj Nath, as then His Lordship was) vide B.A. No. 10370 of 2025 on 01.12.2025 and B.A. No. 9502 of 2025 on 30.10.2025 respectively. It is also submitted that co-accused namely, Surajnath Yadav had also got three (03) criminal antecedent which is mentioned at Paragraph- 179 of the case diary whereas this petitioner has also got three (03) criminal antecedent. It is submitted that the petitioner is in custody since 16.07.2025 and hence, he may be enlarged on bail on the ground of parity.

On the other hand, learned APP for the State has opposed the prayer of bail and submitted that the petitioner is not named in the FIR but he was abetting the terrorist groups. It is submitted that five (05) terrorists are named in the FIR by the Informant and the petitioner also happens to give information by working as a spy. It is submitted that the petitioner has got three (03) criminal antecedents which is mentioned at Para-178 of the case diary and hence, the prayer for bail of the petitioner may be rejected.

Having heard the learned counsel for the parties and going

through the records, it appears that the petitioner is not named in the FIR.

It appears that four (04) other co-accused namely, namely, Rajendra Yadav, Surajnath Yadav and Krishna Yadav, who were apprehended with this petitioner, had been granted bail by the Co-ordinate Bench (Justice Ambuj Nath, as then His Lordship was) vide B.A. No. 10370 of 2025 on 01.12.2025 and another co-accused namely, Prasad Yadav @ Ram Prasad Yadav, who was also apprehended with this petitioner, had been granted bail by the Co-ordinate Bench (Justice Ambuj Nath, as then His Lordship was) vide B.A. No. 9502 of 2025 on 30.10.2025.

Considering the custody and the fact that four (04) other co-accused namely, namely, Rajendra Yadav, Surajnath Yadav, Krishna Yadav and Prasad Yadav @ Ram Prasad Yadav, who were apprehended with this petitioner, had been granted bail by the Co-ordinate Bench vide B.A. No. 10370 of 2025 on 01.12.2025 and vide B.A. No. 9502 of 2025 on 30.10.2025 respectively, the petitioner namely, Satyendra Yadav is also directed to be released on bail, on furnishing bail bonds of Rs.15,000/- (Rs. Fifteen Thousand) with two sureties of the like amount each, to the satisfaction of Sri Utkarsh Jain, learned J.M. 1^st Class, Latehar or his Successor Court in connection with Netarhat P.S. Case No. 12 of 2024, subject to the condition that one of the bailors must be the own relative of the petitioner and also subject to his undertaking that he will not commit such type of mistake in future again, failing which, the Prosecution/Informant will be at liberty to take steps for cancellation of his bail and also subject to the condition that the petitioner shall not leave the jurisdiction of Trial Court without prior permission of the learned Court below and his bailors

shall submit their respective Aadhar Cards and their Mobile Numbers before the learned Trial Court below and they shall not change their Mobile Numbers till the conclusion of trial.

Thus, B.A. No. 10229 of 2025 is allowed and stands disposed of.
