The present C.M.P. has been filed for restoration of C.W.J.C. No. 2574 of 1993 (R) which was dismissed for non-prosecution vide order dated 21^st August, 2026. The copy of the said petition has been served to the learned counsel appearing for the respondents.

Learned counsel for the petitioner has submitted by showing the reason for dismissal for non-prosecution of the present case that when the matter was listed on the board, both the advocates on record, since were indisposed, as such could not appear giving due representation to the petitioner, having consequence thereof, C.W.J.C. No. 2574 of 1993 (R) was dismissed for non-prosecution.

It is submitted that if the present petition will not be allowed, the

petitioner will suffer irreparable loss and injury.

Mr. Mrinal Kanti Roy, learned Sr. S.C. appearing for JUVNL and Mr. Manoj Tandon, learned counsel appearing for the BSEB in all fairness have submitted that the matter may be restored so that the matter be decided on merits.

Considering the submission as also the reason assigned in the instant petition and having no objection on behalf of the learned counsel for the respondents, the present C.M.P. is allowed.

Consequently, C.W.J.C. No. 2574 of 1993 (R) is restored to its original file.
