direction upon the respondent no. 3 to accept rent of the land appertaining to Khata No. 197, Jamabandi Nos. 14/1, 14/9 & 14/10, Plot Nos. 120, 121 & 122, measuring an area of 2 acres which is registered in the name of the petitioner. Further prayer has been made for issuance of direction upon the respondent no. 3 to issue rent receipt in favour of the petitioner after accepting the rent from him. The petitioner has also prayed for issuance of direction upon the respondent no. 3 to consider his representation dated 05.10.2024.

Learned counsel for the petitioner submits that the petitioner has lawful right and title over the aforesaid land having purchased the same from one Ved Prakash Gupta vide registered sale deed dated 20.08.1992. He has also paid rent to the State Government for the said land till the year 2012-13 for which rent receipts have also been issued to him. However, subsequently the rent for the said land is not being accepted without disclosing any reason. The petitioner has represented the respondent no. 3 in this regard on different occasions, however, no action on the same has

been taken by the said respondent, which has compelled him to prefer the present writ petition.

3. Mr. Rakesh Kumar Roy, AC to GA-III appearing on behalf of the respondents, submits that if the petitioner prefers a fresh representation in this regard before the respondent no. 3, an appropriate decision will be taken by the said respondent within a timeframe.

Having heard learned counsel for the parties and considering the nature of prayer made in the writ petition, without entering into the merit of the case, the petitioner is given liberty to prefer a fresh representation on the present issue before the respondent no. 3. On receipt of the said representation, the respondent no. 3, after verifying the relevant records and on providing an opportunity of hearing to the petitioner/his representative, shall take an appropriate informed decision in accordance with law within six weeks from the date of filing of the representation.

5. The writ petition is accordingly disposed of with aforesaid liberty and direction.
