The instant writ application has been preferred by the petitioner for following reliefs:-

Rule NISI issuance an (i) for of appropriate writ or a writ of or in the nature of a writ of certiorari for quashing the order dated 16.1.2018 Annexure-4 passed by the respondent no.2 Chairman cum Disciplinary Authority Vananchal Gramin Bank where by and whereunder, in connection with departmental enquiry held, the petitioner has been imposed major penalty of reduction to five lower stages in time scale of pay for a period of one year only under Regulation

No.39.1.(b) (i) of Chapter 4 of the Vananchal Gramin Bank Officers and Employees Service Regulation 2010 and further ordered that the petitioner who is drawing basic pay of Rs.55870/-which will be reduced to Rs.48750/- up till his date of retirement i.e. 31.12.2018 which is totally illegal, arbitrary violative of articles 14, 16 and 19 of the Constitution of India and also in violation to the principle of natural justice equity and fair play and visits the petitioner with civil consequences:

Rule NISI issuance an (ii) for of appropriate writ or a writ of the nature of a writ of commanding or in mandamus and directing upon the concerned respondents to certify and show cause before this Hon'ble Court as to why and under what circumstances the petitioner has not been granted promotion from the post of MMGS II to MMGS III inspite of the fact that the petitioner was called for in the interview for the post to which he was eligible for promotion from the post of MMGS II to MMGS III for promotion year 2018-2019;

Rule NISI issuance an (iii) for of appropriate writ or a writ of on in the nature of a writ of prohibition prohibiting the concerned respondents from acting in pursuance to the order dated 16.1.2018 by which the major penalty has been imposed on the petitioner by reducing five lower stages in

time scale of pay for a period of one year only under Regulation No.39.1. (b) (1) of Chapter 4 of the vananchal Gramin Bank Officers and Employees Service Regulation 2010.

2. During course of hearing Ld. Counsel for the Respondents draws attention of this court towards the pendency of the suit which has been filed by the Petitioner himself for the same grievance amongst other, what has been prayed in this writ application.

3. After some argument, Ld. Counsel for the Petitioner submits that the instant writ application may be disposed of by giving liberty to the Petitioner to take all grounds before the concerned trial court where the suit is pending and a liberty be given to take an appropriate action pursuant to the judgment passed by the concerned court as and when required.

4. There is no objection from the Respondents.

5. Accordingly, the instant writ application stands disposed of with the liberty as prayed for. Pending I.A., if any, is also closed.
