The instant writ application has been preferred by the petitioner praying for a direction upon the respondent-authorities to consider and grant the benefit of the post of Assistant Sub Inspector of Police with effect from 20.10.2012 and to consider the case of the petitioner for promotion on the higher post of Sub-Inspector of Police from the due date and within the specified period.

Learned counsel for the petitioner submits that the counter affidavit dated 01.04.2019 has been filed by the State and in paragraph no. 15 at page-15, they have granted the claim of promotion; however, now the only dispute remains that as per the claim of the petitioner, the promotion should have been granted from 20.10.2012. However, he has been granted promotion from 24.06.2015. Accordingly, instead of litigating this case much as the petitioner has already retired; the instant

case may be disposed of by granting liberty to the Petitioner to approach the 3^rd Respondent along with relevant record so that the dispute may be resolved.

Learned counsel for the Respondents relies upon the counter affidavit and submits that the Petitioner has rightly been given the promotion; however, if the petitioner so chooses; he may approach the concerned authority but there is no illegality in granting promotion to the petitioner from 24.06.2015.

Having heard learned counsel for the parties and after going through the documents available on record and the averments made in the respective affidavit it appears that the prayer of the Petitioner has partly been allowed and the only dispute remains with the date from which he should be granted promotion; as such interest of justice would be sufficed by granting liberty to the Petitioner to approach the concerned respondent along with all relevant record of the case.

Accordingly, the instant writ application stands disposed of by directing the Petitioner to approach the 3^rd Respondent within a period of 6 weeks from the date of receipt of copy of this order, by filing a detailed representation as the petitioner had already retired. The petitioner may approach before the 3^rd Respondent through his counsel, along with all relevant record. The moment the 3^rd Respondent comes across the said representation, it would decide the case of the Petitioner in accordance with law and applicable rules and regulation within a period of four months from the date of filing of such representation.
