Jageshwar Prasad Yadav Vs the State of Jharkhand

The instant writ petition has been filed under Article 226 of the Constitution of India for direction upon the respondents to conclude the proceeding of Suspicious Jamabandi Case No. 01/2014-15.

Learned counsel for the petitioners submits that the land appertaining to Mauza Baduliya, Thana No. 163, Khata Nos. 34, 39, 40 and 42, total area of 57.80 decimals, is the ancestral property of petitioner nos. 1 and 2 and they have been paying rent to the sarishta of Government. It is further submitted that the land appertaining to Mauza Baduliya, Thana No. 163, Khata Nos. 34 and 40, total an area of 14.20 decimals was transferred by the ancestors of petitioner nos. 1 and 2 through Hukumnama to one Tippan Rai, grandfather of petitioner no. 3, and his name also finds place in Register-II.

It is argued that due to involvement of some local persons and in connivance of some officials, the land appertaining to Mauza Baduliya, Thana No. 163, Khata Nos. 34, 39, 40 and 42 was mutated in the name of one Jagdish Rai and some other persons.

Petitioner no. 1 filed an application before the Circle Officer, Jainagar on 27.06.2014 which was registered as Suspicious Jamabandi Case No. 01/2014-15. Land Reforms Deputy Commissioner, Koderma remanded the case to the circle officer, but no final order has been passed so far.

Under the circumstance, the Circle Officer, Jainagar (Respondent no. 4) is directed to dispose of Suspicious Jamabandi Case No. 01/2014-15 after hearing the parties within a period of four weeks from the date of receipt/production of a copy of this order.

With the aforesaid direction, Writ Petition stands disposed of. I.A., if any, also stands disposed of.
