of defendants in title suit No. 8/87 the defendant was liable to pay rent by 10th of every month as shall appear from Ext-16/A which is letter written by the landlord to the original defendant agreeing to give rebate in the monthly rent on the condition that the tenant would pay monthly rent by 10th of every month. The defendant attorned the said proposal by making endorsement in Ext-16/A. Though in title Eviction Suit No. 8/87 the defendants have filled money order coupons which are Ext-A to A/198 and has also filed postal receipts for the saine, which are Ext- B to B/156 therefore from the serial number, it appears that the defendants have filed more money order coupons than its postal receipts. Without postal receipt the tender through money order coupons shall not be turned as a valid tender of rent under the law. Therefore we shall examine these document that as to whether the defendant have sent the rent by 10th day of every month or not and on perusal of money order receipt i.e. Ext-B/10, B/16, B/17, B/18, B/21, B/23 to B/31, B/34, B/36 B/37, B/39, B/40, B/43, B/45, B/47 to B/51, B/54 to B/59, B/61, B/62, B/64,B/67, B/68, B/71, B/73, B/74, B/76, B/78, B/80, B/84 to, B/87, B/90, B/91, B/93, B/98, B/106, B/108, B/110, B/125, B/135, 5/139, B/147, B/150 and B/152 are the postal M. O. receipt which shows that the money order was sent after the 10th of respective month.
