8 /09.07.2025 The learned counsel appearing on behalf of the appellant submits that inadvertently the appeal has been filed before this Court in light of Order XLIII Rule (1)(r) of the C.P.C., however, in light of the pecuniary jurisdiction, the appeal will lie before the learned District Judge and in view of that the learned counsel for the petitioners seeks permission to withdraw the instant appeal with liberty to move before the learned District Judge.

This appeal is permitted to be withdrawn and disposed of with the aforesaid liberty.
