This Criminal Appeal has been filed on behalf of the appellants challenging the order dated 26.05.2023 passed by Sri Gopal Pandey, learned Special Judge SC/ST Act, Giridih in A.B.P No.1906 of 2022, arising out of SC/ST Case No.30 of 2022, instituted under sections 323, 324, 504, 34 of IPC and Sections 3 (1) (r) (s) of the SC/ST (Prevention of Atrocities) Act by which the prayer for anticipatory bail of the appellants has been rejected.

After some argument, learned counsel for the appellants seeks permission to withdraw the prayer for anticipatory bail on behalf of the Appellant No.1 and 2 namely, Praveen Verma @ Praveen Kumar and Pintu Verma @ Pintu Kumar to move before the learned Trial Court below in the light of the judgment reported in (2021) 10 SCC 773 (Satender Kumar Antil vs. Central Bureau of Investigation and another).

Learned counsel for the appellants submitted that the Appellant No.3-Munna Verma @ Munna Prasad Verma is father of Appellant No.1 and 2 and he has been falsely implicated on account of enmity between the informant and his sons.

Learned counsel for the State as well as Respondent No.2 have opposed the prayer for anticipatory bail.

So far as Appellant No.3-Munna Verma is concerned, he is father of the Appellant No.1 and 2 and the allegation against him is general and omnibus in nature.

Accordingly, the Appellant No.3-Munna Verma is directed to surrender before the learned Court below within four weeks from today and in the event of his arrest or surrender, the Appellant No.3-Munna Verma is directed to be released on bail, on furnishing bail bonds of Rs.15,000/- (Rs.Fifteen Thousand) with two sureties of the like amount each, to the satisfaction of the learned Special Judge SC/ST Act, Giridih in connection with SC/ST Case No.30 of 2022.
