The appeal challenged the order dated 07.07.2025 passed in B.P. No. 854 of 2025 (Bariyatu P.S. Case No. 63/2025) by the learned Judicial Commissioner, Ranchi, rejecting the appellant Prem Pandey's bail prayer in a case wherein the informant was shot at his neck and hand when two miscreants opened fire at his vehicle. The appellant, in custody since 23.02.2025, had been implicated on the confessional statement of co-accused Karan Oraon, a fact the learned APP did not dispute. On consideration of the manner of implication of the appellant, the Division Bench set aside the impugned order and directed release on bail on furnishing a bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class-XXI, Ranchi.

Heard the learned counsel for the respective sides.

This appeal is directed against the order dated 07.07.2025 passed in B.P. No. 854 of 2025 in connection with of Bariyatu P.S. Case No. 63/2025 by the learned Judicial Commissioner, Ranchi, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that when the informant and his bodyguard were travelling on his vehicle, two miscreants had opened fire as a result of which the informant was shot at his neck and hand. The bodyguard of the informant retaliated at which the miscreants had fled away.

Submission has been advanced by the learned counsel for the appellant that the First Information Report has been registered against unknown persons. It has been submitted that subsequently on the confessional statement of co-accused Karan Oraon, the appellant has been implicated. Learned counsel adds that the appellant is in custody since 23.02.2025.

Learned APP though has opposed the prayer for bail of the appellant, but has not disputed the fact regarding the name of the appellant having transpired in the confessional statement of co-accused Karan Oraon.

On consideration of the manner of implication of the appellant, we while setting aside the order dated 07.07.2025 passed in B.P. No. 854 of 2025 in connection with of Bariyatu P.S. Case No. 63/2025 by the learned Judicial Commissioner, Ranchi, direct that the appellant be released on bail on

furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class-XXI, Ranchi in connection with of Bariyatu P.S. Case No. 63/2025.
