This appeal is directed against the order dated 13.08.2025 passed by the learned Additional Sessions Judge-I, Pakur in B.P. No. 254 of 2025 corresponding to Pakur (Malpahari O.P.) P.S. Case No. 153 of 2024, whereby and whereunder the prayer for bail of the appellant has been rejected.

It has been alleged that the informant and several other persons were subjected to assault by the appellant and 11 other accused persons which resulted in their suffering injuries.

Submission has been advanced by learned senior counsel for the appellant that none of the injuries were opined to be grievous in nature. It has been submitted that in similar circumstances some of the co-accused persons have been granted bail by a Coordinate Bench of this Court in Cr. Appeal (DB) No.113 of 2025 and Cr. Appeal (DB) No.1080 of 2024. It has been submitted that the allegations are general and omnibus in nature so far as the present appellant is concerned and he is in custody since 22.07.2025.

Learned A.P.P. though has opposed the prayer for bail of the appellant, but has not disputed the fact that case of the present appellant is similar to those co-accused persons who have already been granted bail by this Court.

Regard being had to above, we while setting aside the order dated 13.08.2025 passed by the learned Additional Sessions Judge-I, Pakur in B.P. No. 254 of 2025 corresponding to Pakur (Malpahari O.P.) P.S. Case

No. 153 of 2024, direct the appellant to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Pakur in connection with Pakur (Malpahari O.P.) P.S. Case No. 153 of 2024.

This appeal stands allowed and disposed of.
