02/09.09.2025 Heard Mr. Sahil, learned counsel for the appellant and Mr. Rajneesh Vardhan, learned A.P.P. for the State.

This appeal is directed against the order dated 31.07.2025 passed by the learned Addl. Sessions Judge-V, Chatra in Misc. Criminal Application No. 1046 of 2025, arising out of Piparwar P.S. Case No. 56 of 2023, corresponding to S.T. No. 172/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that two extremists were apprehended by the Police and from their possession arms and ammunitions were recovered.

So far as the present appellant is concerned, his name appears to have transpired on the confessional statement of the apprehended accused persons. It further appears that in similar circumstances one of the co-accused Nageshwar Ganjhu @ Mukhiya Jee has been granted bail by a coordinate Bench of this Court in Criminal Appeal (DB) No. 1152 of 2024. The appellant is in custody since 25.03.2025.

Regard being had to the above, we while setting aside the order dated 31.07.2025 passed by the learned Addl. Sessions Judge-V, Chatra in Misc. Criminal Application No. 1046 of 2025, arising out of Piparwar P.S. Case No. 56 of 2023, corresponding to S.T. No. 172/2025, direct that the

appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Addl. Sessions Judge-V, Chatra in connection with Piparwar P.S. Case No. 56 of 2023, corresponding to S.T. No. 172/2025.
