The instant Cr. M. P. No. 3984 of 2022 has been filed on behalf of the petitioner for restoration of Criminal Revision No. 283 of 2001, which stood dismissed for nonprosecution vide order dated 12.03.2018 passed by the Co-ordinate Bench (Justice Anant Bijay Singh as then His Lordship) of this Court.

It has been submitted by the learned counsel for the petitioner that the Criminal Revision No. 283 of 2001 has been filed in the year 2001 and the petitioner was granted bail by the Co-ordinate Bench of this Court. Thereafter several counsels left the office and several new counsels joined in the office of the conducting counsel. It is submitted that when the case was listed in the year 2017, no one appeared to prosecute the case as Mr. Vijay Gopal stopped coming to the Court and Mr. Ajay Kumar Singh could not inform his old office colleagues regarding the listing of the case and as such, the case stood dismissed for non-prosecution vide order dated 12.03.2018. It is submitted that the petitioner shall remain

careful in future and hence, Cr. M. P. No. 3984 of 2022 may be allowed and Criminal Revision No. 283 of 2001 may be restored to its original file.

Learned counsel for the State raised no objection.

It appears that the Criminal Revision No. 283 of 2001 was dismissed for non-prosecution vide order dated 12.03.2018 passed by the Co-ordinate Bench (Justice Anant Bijay Singh as then His Lordship) of this Court

Having heard learned counsel for the parties and in view of the averment made in para-6 to 10 of the instant petition, the present Cr. M. P. No. 3984 of 2022 is allowed. Criminal Revision No. 283 of 2001 is restored to its original file.
