Heard learned counsel for the parties.

2. This application has been filed for modification in order dated 16.10.2023 passed in A.B.A. No. 6963 of 2023 with a prayer to extend the period of surrender of the petitioner in the court below.

It is submitted by learned counsel for the petitioner that petitioner had moved before this Court in anticipatory bail application vide A.B.A. No. 6963 of 2023 and this Court vide order dated 16.10.2023 had granted anticipatory bail to the petitioner and the petitioner was directed to surrender in the court below within four weeks from the date of the order, but the petitioner could not surrender in the court below within the aforesaid period.

4 . It is further submitted by learned counsel for the petitioner that petitioner is a poor person and had gone to earn his livelihood out of State. When he got the information, he came to Ranchi by taking leave and arranged Rs.5000/- and ready to deposit the same in the court but the same could not be done within the time granted by this court. Therefore, it is prayed that for the ends of justice, the period for surrender of the petitioner in the court below may be extended by further six weeks.

5 . In view of the above submissions, the order dated 16.10.2023 passed in A.B.A. No. 6963 of 2023 is modified to the extent that the petitioner shall surrender before the court below within two weeks from the date of receipt of copy of this order.

6 . Rest part of the order dated 16.10.2023 shall remain intact.

7 . Cr.M.P. No. 305 of 2025 stands allowed.
