regard to prayer no. (B) wherein prayer has been made to set aside the order dated 07.11.2019 passed in connection with R.C. No. 12/S/2014-

EOW-R whereby non-bailable warrant of arrest has been issued against the petitioner, pending in the court of learned Special Judge-II, C.B.I., (Other than AHD Scam Cases) Ranchi, Jharkhand.

3. Learned counsel for the petitioner submits that he has got instruction from the petitioner that he will appear before the learned court on 03.11.2025 which is the next date fixed in the case and in view of that non-bailable warrant of arrest may kindly be quashed.

4. Learned counsels for the C.B.I. and State jointly oppose the prayer and submit that even the quashing application of the petitioner has been rejected in spite of that the petitioner has not appeared before the learned court.

5. In view of above facts and considering that the purpose of nonbailable warrant was of appearance of the petitioner and the petitioner is ready to appear on the next date fixed i.e. on 03.11.2025. In view of that this petition is disposed of directing the petitioner to appear before the learned court on 03.11.2025. If the petitioner appears on or before such date, N.B.W. shall not be given effect to.

6. It is made clear that if the petitioner fails to appear before the learned court on or before the date assigned by this Court, the learned court shall take all the coercive steps against the petitioner.

7. With the aforesaid observation and direction, this criminal miscellaneous petition stands disposed of. Pending petition, if any, is also disposed of.
