Case No. 09 of 2024, in which cognizance had been taken under sections 395, 397, 412 and 120(B) of the Indian Penal Code (offences originally registered under sections 341, 342, 147, 148, 149, 323, 461, 380, 399, 402/34 IPC), pending before the learned Additional Chief Judicial Magistrate, Ramgarh. The case arose out of a dacoity committed on 11.01.2024 at about 1.0 a.m. at the store area of an Excavation Project by about 30-35 armed persons, who assaulted security guards, snatched their mobile phones, locked them inside a room and looted materials worth Rs. 17,53,446/-. Counsel submitted that the petitioner was not apprehended at the spot, his name had emerged in the confession of the apprehended co-accused, and several similarly situated co-accused had already been granted bail by different coordinate Benches of the Court. In view of these submissions, the Court directed the petitioner's release on bail on furnishing bail bonds of Rs. 20,000/- with two sureties of the like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Ramgarh.

Petitioner has been made accused in connection with Mandu (W.B) P.S. Case No. 09 of 2024 for the offences registered under sections 341, 342, 147, 148, 149, 323, 461, 380, 399, 402/34 of the Indian Penal Code (Cognizance has been taken under section 395, 397, 412, 120(B) of the Indian Penal Code), pending in the court of learned Additional Chief Judicial Magistrate, Ramgarh.

On 11.01.2024 at 1.0 a.m., about 30-35 armed persons came to the store area of Excavation Project and started assaulting security guards present there. They also snatched their mobile phones and locked them inside the room and committed dacoity. Accused persons looted materials worth Rs. 17,53,446/from there.

It was submitted that about ten persons were apprehended by the Police. It was further submitted that the petitioner was not apprehended at the spot and his name has come in the confession of the apprehended co-accused. It was further submitted that several similarly situated co-accused persons have been granted bail by different coordinate Benches of this court earlier.

In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Ramgarh in connection with Mandu (W.B) P.S. Case No. 09 of 2024.
