Heard learned counsel for the parties.

2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 376(1), 456, 457 of the IPC.

3. Learned Counsel for the Petitioner submits that there is inordinate delay in lodging of the FIR, inasmuch as, the alleged incident occurred on 16.05.2024 and the FIR has been lodged on 9/10/24. He further submits that as a matter of fact, the petitioner has falsely been implicated in this case and is lying in custody since 9/10/2024.

4. Learned counsel for the State opposes the prayer for bail and submits that the victim has given a statement and supported the prosecution case.

Having regard to the facts and circumstances of the case and looking to the allegation coupled with the fact that the FIR was lodged after a long delay, the Petitioner is enlarged on bail by furnishing bail bond of ₹ 20,000/- each (INR Twenty Thousand Only) with two sureties of like amount each, to the satisfaction of the learned Additional Sessions Judge-III (I/C), West Singhbhum Chaibasa in connection with Anandpur P.S. Case No.18 of 2024, corresponding to S.T. case No.59/25, G.R. No.259/2024.

6. It is made clear that during trial the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co-operate in trial. Further the petitioner will submit photocopy of his Aadhaar Card and mobile number before the court below which he will always keep active and will not change and if any adverse report will come against this petitioner, learned trial court shall be at liberty to take appropriate action.
