Heard the parties.

The petitioner has been made accused in connection with Ramgarh P.S. Case No. 29 of 2023, for the offence under Sections 395 and 412 of the Indian Penal Code, pending in the court of Shri Aditya, learned Judicial Magistrate, 1^st class, Dumka.

On 10.04.2023 at about 03:30 a.m., the informant was waylaid by unknown dacoits near Delipathar bridge, Ramgarh.

It was submitted that petitioner is neither named in the F.I.R nor he was put on T. I. Parade. It was further submitted that nothing incriminating has been recovered from the possession of the petitioner. It was finally submitted that several co-accused persons, who faced separate trial, have been acquitted.

Learned A.P.P on behalf of the State though has opposed the prayer for bail but does not dispute the aforesaid submission.

In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Shri Aditya, learned Judicial Magistrate, 1^st class, Dumka, or his successor, in connection with Ramgarh P.S. Case No. 29 of 2023.
