2. The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No.39 of 2025, for the alleged offences registered under Sections 111(2)(b), 111(3), 111(4), 112(2), 317(2), 317(4), 318(2), 318(4), 319(2), 336(2), 336(3), 338, 340(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 66(B), 66(C) and 66(D) of I.T. Act pending in the Court of learned Judicial Magistrate, 1^st Class, Dumka.

Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR and in the course of investigation three of the accused persons have taken the name of the petitioner saying that the petitioner is the associate of three persons. He further submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.19 of the petition. He then

submits that by the last order case diary was called for and in the case diary apart from that nothing has come against the petitioner and the case diary is also silent on the point of criminal antecedent.

4. Learned counsel appearing for the State opposes the prayer and submits that the name of the petitioner has come on the confessional statement of three of the apprehended co-accused.

Considering that the name of the petitioner has come on the confessional statement of three of the apprehended co-accused and the petitioner has got no criminal antecedent as disclosed in paragraph No.19 of the petition and the case diary is also silent on the said point, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1^st Class, Dumka in connection with Ramgarh P.S. Case No.39 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
